Terms of Service

Last updated: 29 September 2026

1. About Plantly

Plantly is a plant care application developed and operated by Dennis van den Brock, Josef-Wolter-Weg 2, 41569 Rommerskirchen, Germany ("we", "us", "our"). These Terms of Service ("Terms") describe use of the Plantly app and website and form part of the service contract when agreed during registration or purchase.

If you do not agree with these Terms, do not use the service.

2. Eligibility

You must be at least 16 years old to use Plantly. By using the service, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Your account

You are responsible for keeping your login credentials secure. Do not share your password. Contact us promptly if you suspect misuse. Responsibility for unauthorised activity is determined by applicable law.

Notify us immediately at [email protected] if you suspect unauthorised access to your account.

We may restrict access where necessary to address misuse, security risks, or a material breach of these Terms. Where appropriate, we will explain the reason and give you an opportunity to remedy the breach. Statutory termination and refund rights remain unaffected.

4. Free tier and Premium

Plantly offers a free tier and a paid Premium subscription.

Free tier includes: up to 10 active plants per household, 5 shared AI requests per week across plant identification and health checks, 5 AI chat replies per week in a separate chat quota, one household, and core care tracking features.

Premium unlocks: unlimited plants, 30 shared AI requests per week across plant identification and health checks, AI chat without a weekly message quota, additional care and companion features, and Premium for one assigned household.

The features, limits, household coverage, and price shown before purchase define your selected plan. AI chat and scan quotas are separate. Technical rate limits and protections against abuse still apply. Changes to an existing contract are subject to section 9.

5. Subscriptions and payments

New in-app subscriptions are billed through Google Play or Apple and synchronized by RevenueCat. Existing Stripe subscriptions continue. The store displays the local total price, selected monthly or annual billing interval and scope before purchase. We do not store full card numbers or card security codes.

Recurring subscriptions renew for the billing period stated in your offer unless cancelled. Manage and cancel Google Play and Apple subscriptions in the respective store; the app opens its management page. Existing Stripe subscriptions can still be cancelled in the app. The cancellation confirmation shows when paid access ends. Uninstalling the app does not cancel a subscription.

Any statutory right of withdrawal, refund, price reduction, or termination remains unaffected. Starting to use Plantly does not by itself waive these rights. Where a statutory withdrawal right applies, the required information and any request for early performance must be provided separately as part of the purchase process.

6. Your content

You retain ownership of all content you submit to Plantly — plant photos, notes, journal entries, and chat messages. By uploading content, you grant us a limited, non-exclusive licence to store, display, and process it to provide the service, including processing by the providers described in our Privacy Policy and sharing with household members or sitters according to the access you grant.

You must not upload content that is unlawful, harmful, or infringes third-party rights.

7. Acceptable use

You agree not to:

  • Attempt to access, tamper with, or disrupt our servers or infrastructure.
  • Reverse-engineer, decompile, or extract source code from the app except where applicable law permits it.
  • Use the service to store or transmit malware or any harmful code.
  • Scrape or bulk-download data from the service.
  • Impersonate another person or entity.

8. Plant identification, health checks, and AI chat

PlantNet provides plant identification and disease suggestions. AI chat and additional health advice use models accessed through OpenRouter. Responses may use the relevant plant, household, care, and journal context. AI-generated answers can be incomplete or incorrect. Prepared chat actions require your review and confirmation before they are saved.

These features provide general plant-care guidance, not guaranteed identification or professional medical, veterinary, or pesticide advice. Do not rely on them to decide whether a plant is edible or safe for people or pets. Follow product labels and obtain qualified advice for safety-critical decisions.

Plant identification and health checks share the weekly scan quota; AI chat has its own quota. Weather adjustments and care reminders are aids and do not guarantee plant health or timely notification delivery. Your statutory rights and section 12 remain unaffected.

9. Availability, changes, and ending the service

Maintenance and technical failures may temporarily affect availability. We provide updates required by applicable law. Changes beyond those necessary to maintain conformity are subject to the legal requirements for digital products, including any required contractual basis, valid reason, notice, and termination rights; these Terms do not grant an unrestricted right to remove paid features.

Changes to these Terms require a valid legal basis or your agreement. Continued use alone does not constitute acceptance of new contractual terms.

You can request account deletion in the app or on our account deletion page. Deletion revokes account access and initiates removal of account data and cancellation of Stripe and Google Play subscriptions. You must cancel Apple subscriptions separately in the App Store; account deletion does not end their billing. Shared households may first need to be transferred to another active member. Shared records and legally required billing records are handled as described in our Privacy Policy.

10. Intellectual property

The Plantly name, logo, app design, and all original content produced by us are our intellectual property. Nothing in these Terms grants you a right to use our trademarks or branding.

11. Statutory rights

Your statutory rights relating to defective or non-conforming digital services, required updates, remedies, and consumer protection remain unaffected. Nothing in these Terms excludes mandatory warranties or remedies.

12. Liability

Liability is governed by applicable law. These Terms do not impose a monetary liability cap or exclude liability for intent, gross negligence, injury to life, body, or health, or any other liability that cannot legally be excluded.

13. Governing law

German law applies. If you are a consumer, this choice does not deprive you of mandatory protections of the law of your habitual residence. Jurisdiction is determined by applicable law; these Terms do not impose an exclusive German court venue on consumers.
