Terms of Service

Plantly is a plant care application developed and operated by Dennis van den Brock, Germany ("we", "us", "our"). By creating an account or using the Plantly app or website, you agree to these Terms of Service ("Terms").

If you do not agree with these Terms, do not use the service.

You must be at least 16 years old to use Plantly. By using the service, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for keeping your login credentials secure. Do not share your password. You are responsible for all activity that occurs under your account.

Notify us immediately at dennisvandenbrock54@gmail.com if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

Plantly offers a free tier and a paid Premium subscription.

Free tier includes: up to 15 active plants per household, 5 plant scanner identifications per day, one household, and core care tracking features.

Premium unlocks: unlimited plants, up to 25 scanner identifications per day, multiple households, additional companion forms, and future premium features.

We may adjust these limits over time. We will communicate material changes in advance.

Premium subscriptions are billed through the Apple App Store or Google Play Store, or directly via Stripe, depending on how you subscribed. All payments are handled by the respective platform or Stripe — we do not store your payment details.

Subscriptions auto-renew unless cancelled before the renewal date. Cancellation policies follow the rules of the platform through which you subscribed (App Store, Play Store, or Stripe billing portal).

Refunds are handled according to the relevant platform's refund policy. We do not offer refunds for partial billing periods.

You retain ownership of all content you submit to Plantly — plant photos, notes, journal entries. By uploading content, you grant us a limited, non-exclusive licence to store, display, and process it solely to provide the service to you.

You must not upload content that is unlawful, harmful, or infringes third-party rights.

You agree not to:

• Attempt to access, tamper with, or disrupt our servers or infrastructure.
• Reverse-engineer, decompile, or extract source code from the app.
• Use the service to store or transmit malware or any harmful code.
• Scrape or bulk-download data from the service.
• Impersonate another person or entity.

The plant identification feature is powered by PlantNet. Scanner results are suggestions, not guaranteed identifications. Do not make decisions with safety implications (e.g. edibility, toxicity) based solely on scanner results. We are not liable for misidentifications.

Free accounts may perform up to 5 identifications per day; Premium accounts up to 25.

We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service at any time. For significant changes or discontinuation we will provide reasonable advance notice where possible.

We may update these Terms from time to time. Continued use after notice of changes constitutes acceptance of the updated Terms.

The Plantly name, logo, app design, and all original content produced by us are our intellectual property. Nothing in these Terms grants you a right to use our trademarks or branding.

Plantly is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that plant identification results will be accurate.

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of Plantly. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or €10, whichever is greater.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under German law.

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.
